Bizarre stuff. Any Help?

LONG STORY... skip to the chase at the bottom if so desired(below the 2nd line of asteriks).

Southern California 92deg day. Take a blast on Angeles Crest. No Brainer!

They have been resurfacing Angeles Crest on the lower sections and have done a damn fine job at an unbelieveable pace. A Major Infrastructure Construction Company have been handling the work. The new surface is impeccable.

Their mode of operation on the 2 lane road, is to close down one lane for a distance of 1-2miles, scrape and score the surface and then resurface with premium Asphalt.

For traffic control during the process, they have uni-directional traffic flow,- i.e. vehicles hold at a Stop signal until a 'Pilot' Vehicle appears. The Pilot vehicle will make a U-turn after escorting vehicles coming from the opposite direction and then take up station at the head of the line. When the oncoming traffic has cleared, the pilot vehicle will then escort the waiting traffic up the mountain past the active worksite.

Hope this makes sense!

I was riding up the mountain today and was surprised to discover that they had started to resurface the upper mountain roads(I had been riding there yesterday). Great I thought, finally my tax dollars doing something worthwhile.......!

I waited at the Stop signal and then, in a line of traffic, I followed the Pilot Vehicle up the hill. Lot's of loose gravel, but generally no big deal......

The major problem happened on the return trip

To recap Re-surfacing on Angeles Crest,- Pilot Vehicle, Line of Traffic...

So, I wait at the stop sign. Pilot vehicle shows up. I'm 3rd in line behind an SUV, Police Car is first ...... several cars behind me.

Pilot Vehicle leaves doing about 25-35mph.

Traffic is tightly spaced when I see a Spill of Hot Liquid Tar on the road,- no chance to avoid it..... I have to run thru it.

I have no possibility of stopping to check the tires etc(traffic cannot stop), so I ride the 1+ miles to the end of the construction zone.

Bottom line, tires have become square section, have picked up 'TONS' of gravel etc.....

DAMAGE: Front fender has disintegrated, rear hugger trashed, tar all over the bike, belly pan covered..... tires destroyed,- (HAVE to change them, I could never be sure if they're OK). Not sure of the full extent of the damage. I parked the bike at ProItalia after dark,- Tuesday will reveal the extent.

QUESTION: Anyone ever experience anything similar? Regardless of whether it was a motorcycle or a Car/Truck?

QUESTIONS: If so, what was the response of the construction company? What is their Liability? When the issue was brought to their attention, what was their reponse? Denial or ..etc. etc.? Anyone have an knowledge of the law in this area?

I specifically haven't mentioned the name of the Construction Company here. I want to give them the benefit of an opportunity to respond. I contacted their main Office afterhours and left a message and I also sent them an email. Hopefully they will respond in a favorable (to me!) manner. The point of my post, is to try and get my ducks in a row.

I would very much appreciate any helpful input.

State of California, Contact the department of transportation and file a claim. They will reimburse you for damage to your vehicle due to road hazards i.e. potholes etc.

Do you know if any other vehicles suffered some damage? Perhaps a call/report to CHP would also reveal if others had similar problems? If so, maybe you have a chance to cover some of the costs. Also, if you talk to your insurance agent, maybe they can advise you if they would pursue a claim against the construction company.

This isn't the same situation but generally, if the city or state is aware of a danagerous highway/road condition and were notified, then they can be held liable (usually). I don't know if that would apply here.

That being said, I'll see you tomorrow at Pro Italia. I'm going to try and get a new rear brake pedal and see how much repairing my side panel will cost me.

From the FAQ

If you feel that you have lost money or property as a result of any action or inaction by Caltrans and your claim is for $5,000 or less, you can file your claim directly with Caltrans.

This falls under action since they hired the contractor. The damage is a direct result of caltrans road repair/resurfacing.

Hey Allan,

I can't be there at 9am,- come to think of it don't they open at 10am? Please leave your number with Samson and I'll give you a ring. It would be nice to hook up.

Incidentally, I have a NIB left side Red Mirror/indicator for an F4 sitting in my garage, (bought it as a spare for my old 750). However, I think your damage is leftside? Maybe you can work a deal! Think I paid $80 off ebay.... it's yours for that if you want......

This is THE best resource on the internet....... sometimes makes me GLAD I don't have a life........ KIDDING!!

I'll call the Construction company again in the morning and will then follow thru from there..... as my Irish Grandfather used to say,- "... Fore Warned is Fore Armed...",
which is exactly what I was looking for....

oops! Meant to say mirror assembly is LEFT SIDE. Thought your damage is RIGHT SIDE.

I'm sure that mirror is a $300 item,- maybe you can work an exchange.....

Hi Kevin. Actually PI opens at 9:00 a.m. Chance are, I'll still be there at 10 a.m. if I can get a new brake lever.

In terms of my mirror, it's slightly scratched but it's still in good condition. The worst parts are the brake lever, fairing and framed (scratched by the broken lever). I think I can fix the brake lever but heating it and then carefully bending it back.

I was at PI today.. saw your Senna.. It hurt just looking at the tires and the rear shock. I'd like to know how you get reimbursed by the city since pot holes have cost me many tires.

Thanks Gentlemen,

I contacted the Insurance Dept. at the construction company and a very helpful Lady is starting the process. She will get back to me today or tomorrow. I also downloaded the claim forms as per RobP... that was good info. I haven't had a chance to get to ProItalia yet,- I'm dreading it! But I spoke to Samson and Patrick this morning...

I'll update the board when I know.

Well Kevin, After You Fix The Damage By Attending To The Local Authorities, And If You Wanna See "real Damage", Come Ride In Greece!! Here When We Talk Aboyt Holes On The Roads Its Like Harley. Bigger The Better!! Youll Love The Nature Though
