Emoto- WORST Retailer - Never Again!!!!

More than 5 weeks ago, I decided to order the Samco silicone hose kit for my F4. I found them on Ebay and on Emoto, but I decided to order them from Emoto. 5 weeks later, and needless to say, that my hose kit has not yet arrived.

I have been sending emails to emoto every week, inquiring about my order, and every single week, I was told that the items should arrive any day now.

I can only guess that the items were not in stock (even though in their webpage emoto stated that they were in stock), and that the were lying all this time.

On friday, I got really fed up with this situation, so I send them an email, quoting the EU legislation, and pointing out that if they fail to deliver the item within a month, I am entitled to a full compenstation.

They replied that they would refund my money, but nothing has happened yet!

My advice to all forum members : " KEEP AWAY FROM EMOTO".

This is my email communication with Emoto up to date:

Dear Sir.

It has now been over five weeks since I placed the order with your website, and I have yet to receive my ordered items. As you may (or may not) be aware, under EU and UK laws, I am entitled to a full money refund. Below please find an extract of the relevant EU law:

http://www.adviceguide.org.uk/index/your_world/consumer_affairs/buying_goods_your_rights.htm

Delays in deliveries

If you have been given a date for delivery, your goods must be delivered by that date. If they aren't delivered by then, the trader will have broken their agreement with you, and you are entitled to ask for compensation.

If you have not been given a proper date for the delivery, you won't be able to claim compensation. However, if you think you have waited a reasonable time and the goods still haven't arrived, you should write to the trader, giving a firm date for delivery. This is called 'making time of the essence'. If the trader doesn't stick to this date, you can claim compensation.

If you bought your goods by distance sale, for example by mail order or over the internet, your rights will be different. For more information, see under heading Distance selling.

When you claim compensation for late delivery, the trader may offer you a fixed sum of money. However, you can make additional claims for other losses on top of this, such as the costs of a taking a day off work while you were waiting for goods which didn't arrive.

As well as claiming compensation, you would also be entitled to cancel your order and get your money back. However, if the trader doesn't agree to do this, you may have to go to court to try and get your money back. For more information, see under heading How to deal with a problem with goods

Furthermore, since the purchase was made over the internet, I have the following additional rights:

Distance selling

If you buy goods from a trader without having face-to-face contact with them, this is known as distance selling. Examples of distance sales include goods that are bought:

by telephone or fax, including text messaging and mobile phones
by mail order
electronically through the internet, e-mail or digital television
through a shopping channel or teletext
from a catalogue
through a newspaper or magazine advert order form.
If you buy goods in any of these ways, you have rights on top of those you have when you buy goods in a shop. The most important of these is the right to a 'cooling off' period. This gives you the right to cancel your order within seven working days, without having to pay anything. The trader must tell you about this right when you place your order. Other additional rights you have when you make a distance sale include the right:

to be given the name and address of the trader
to be given the price of the goods, including taxes and delivery charges
to receive the goods within 30 days
to keep or dispose of any goods you receive but have not ordered. If a seller demands payment for goods you haven't ordered, you don't have to pay for them or return them – see under the heading Charging for goods you didn't order.
If you use a credit card to buy goods in any of these ways, you also get special protection against the fraudulent use of your credit card details.

If the trader won't leave you alone and continues to contact you when you've told them not to, they may be guilty of a criminal offence. You should report them to Consumer Direct – see under the heading Further help for contact details.

Waiting for you PROMPT reply

Dear Sir.
i also agree your opinions.because i got same experiences as you last year.the #eMoto# is real WORST Retailer.they were lazy and not responsible.i got the attestation on my hand.that's long story but i only like to tell everybuyer must be carefully if you try to buy something from eMoto.they almost no items in stock which you saw on their page. so.at best. Keep far away from eMoto as possible as you can.or maybe waste your time even your money.

dude, welcome. Do you by any chance have a 990CR? would be neat to see pics....

My biggest mistake was that I thought I would give them the benefit of the doubt, even after all the post I read in the forum! The last email I sent them was this morning, asking them to tell me what information they need to refund my money, and I have yet to receive a reply.

If they were a serious business, they would not try to run their customers away! At the very least, they were obliged to inform me that the item was not in stock (even though they never admitted it).

After all, don’t they say that a returning customer is preferable than a new customer for an organisation? And what kind of name are they making for themselves? It seems to me that Emoto is run by a group of 13 year olds, with no real perception of how business should be conducted.

kind of neat how many first posts come in threads like this.

#11 ·
Dude, I dont know if you are implying that I am making this up because I am a relatively new forum user, but if you are, you are mistaken!

#14 ·
QUOTE=TokyoLunch;192796]not implying anything, especially towards you. I'm speaking about how (not just in this thread, but many others) where the first post (i.e. "1") is climbing aboard the bandwagon. just seems to be a recurring theme....

actually, i think your summary is well documented. Good use of color.

Peronally, never had a problem. Perhaps their expansion of business to Ducati and recently Yamaha products may have overloaded them. Anyone order ducati or yamaha parts from them or know of feedback on other forums?
Am just about to order new screen from them. Will keep you posted on the progress!

Sure.i will put on a complete photo soon.
please take a look above page...the orange one is mine.she is real 990cr.not 910s.and the other 910r.that's my friend's.we went ride together often.i also got a Bimota DB6 last month.

In fact.this 990cr which maybe you have seen her in black/silver on the Tokyo motor show.her number is CR/01.i only changed her body frame.fuel tank and tail color.how do you think???

#22 ·
I dont know what I was thinking, as I said, it was a big mistake! It's been nearly six weeks now, I dont think that the company will cancel the transaction!

#23 ·
It only took me close to one year to get a tank bag from them. Of course, they wouldn't credit my credit card back when I told them I didn't want it any longer. Same excuses of supplier issues. Funny, once I told them via e-mail I was going to the credit card company the bag showed up. I'll never order from them again.
